A 20-year-old made the decision to sue her mother’s doctor because he allowed her to be born.
Evie Toombes was born with Spina Bifida, a spinal condition that’s causes her to be attached to tubes 24-7.
The young lady is of the opinion that if the doctor had given the right advice to her mother, she would not have been born.
Evie also claimed that if her mother’s doctor, Philip Mitchell, had advised her mother to take follic acid supplements to minimise the risk of the spinal defect affecting the baby, she would have delayed her pregnancy and she would not have been born.
Evie’s mother, while backing Evie’s claim, said “I was advised that if I had a good diet previously, I would not have to take folic acid,”. Her case was further backed by Judge Rosalind Coe QC and in the London High Court, it was ruled that had her mother been properly advised, she would have delayed her pregnancy.
In the circumstances, there would have been a later conception, which would have resulted in a normal healthy child,” the judge ruled.
And Evie was awarded rights to millions in damages, enough to take care of her life long needs.
