According to a report by The Guardian UK, a court battle has resulted in a victory for an 83-year-old woman who was married for 66 years.

Harbans Kaur contested her late husband’s will, which left their entire estate to their two sons, excluding her and their four daughters from any inheritance.

Karnail Singh, who passed away in 2021, had specified in his 2005 will that he wanted his wealth to be passed down solely through the male line.

The estate, valued at over £1 million, included a clothing business and multiple properties. Kaur, who had actively participated in the family business and relied on state benefits of around £12,000 per year, argued that she deserved a fair portion of the assets.

Justice Peel, presiding over the case, agreed with Kaur and ruled that she should receive 50% of the net value of the estate. The judge noted that Singh had not made reasonable provisions for his wife, who had played an equal and significant role in both their marriage and the business.

Peel remarked, “It is hard to see how any other conclusion can be reached. After a marriage of 66 years, to which she made a full and equal contribution, and during which all the assets accrued, she is left with next to nothing.”

The court’s decision was praised by Heledd Wyn, a partner at Shakespeare Martineau law firm, who emphasized that it serves as a warning to those seeking to exclude their spouses from their wills.

Wyn stated that this ruling demonstrates that individuals cannot simply be cut out of wills, particularly when they have made substantial contributions over many years. The court’s decision prioritized fairness in this case.
